Privacy Notice

Last Modified: July 24, 2024

This Privacy Notice explains the ways in which we collect, use, and disclose personal information through the website located at https://www.trcretail.com/ (which we refer to in this Privacy Notice as the “site,” which term also includes all subpages, content, and functionality). When we refer to “you” and “your” in this Privacy Notice, we are referring to you as a visitor to and user of the site. “We,” “us,” “our,” and “TRC” refer to TRC Retail, the owner and operator of the site.

PLEASE READ THIS PRIVACY NOTICE CAREFULLY BEFORE USING THE SITE AND BEFORE PROVIDING US WITH ANY INFORMATION THROUGH THE SITE. BY USING OR ACCESSING THE SITE, YOU EXPRESSLY AGREE TO OUR COLLECTION, PROCESSING AND USE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY NOTICE. IF YOU DO NOT AGREE WITH THE FOLLOWING NOTICE, DO NOT USE OR ACCESS THE SITE AND DO NOT PROVIDE US WITH ANY INFORMATION THROUGH THE SITE. This Privacy Notice applies only to information provided and collected through your use of the site, and does not apply to information that we may collect through other means.

1. THE PERSONAL INFORMATION WE COLLECT. “Personal information” (and similar terms, such as personally identifiable information and personal data) refers to information that we could use to personally identify you, a specific individual. Different states define personal information to include different things, but it generally includes information like your name, mailing address, email address, phone number, and social security number. It may also include your IP address if that IP address can be used to identify a particular person.

Below are the types of personal information we collect through the site:

  1. Identification and Contact Information – This is information that identifies you, such as your first and last name, and information that we can use to contact you, such as your email address, mailing address, and phone number. We collect this information when you voluntarily provide it to us, such as by using the “Contact Us” or similar features of our site to communicate to us. We use this information only to communicate with you and to respond to your inquiry, to send you information you have requested, and to contact you when reasonably necessary.
  2. Device and Browsing Information – You can visit the site anonymously to learn about us and our properties. Like many websites, our site automatically collects certain information from visitors to our site, such as your IP address, browser type, domain information, site access time(s), and referring website address(es). We do not use this information to personally identify you, but are including it here so that you can understand that we may collect this information when you use the site. We use this information for site analytics and to assess and improve the functionality of the site.
  3. Other Information You Voluntarily Provide – When you interact with us through the site, such as by emailing us or using the “Contact Us” or similar features of our site, we will receive any additional personal information that you include as a part of your communication. We will use this information only as necessary to communicate with you and respond to your inquiry.

You are in control over whether you provide us with any personal information, or other information that you may consider sensitive or personal, through the site. If you are not comfortable with how we may use any of your information, you should not provide it.

In addition to the uses of personal information described above, we will use personal information as necessary to comply with legal requirements, as well as to enforce our rights and remedies, and defend against legal claims. In addition, we may use personal information for safety and security purposes, including detecting, preventing, and responding to fraud, intellectual property infringement, violations of any site policies, violations of law, or other misuse of the site. However, we will not use personal information for any purpose that is not reasonably necessary for or compatible with the purposes described in this Privacy Notice or other site policies unless we obtain your consent to do so.

2. HOW WE MAY SHARE PERSONAL INFORMATION.We may provide information to our affiliates and to our other trusted service providers who use that information only to conduct business on our behalf. For example, they may handle our data management and email distribution. We may also share personal information with analytics providers, to compile statistics and evaluate and perform analytics and site improvements. We provide these service providers only with the information they need to perform their services, and work with them to respect and protect your privacy.

We will release information, including personal information, if we believe that such action is appropriate to (a) comply with law, regulations, legal process or governmental request, (b) enforce any site policies, including potential violations, (c) detect, prevent or otherwise address fraud, security or technical issues, or (d) otherwise protect the rights, property or personal safety of us, our employees, site users or others.

Also, we may share information in connection with, during negotiations of, or as a part of the closing of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company, whether as a going concern or as part of bankruptcy, litigation or similar proceeding, in which personal information about the users of our site is among the assets transferred.

We do not share, sell, rent, or lease any personal information that we collect about you through the site to anyone for any purpose other than as disclosed.

3. COOKIES; DO NOT TRACK REQUESTS.The site may use “cookies” (small data text files) to collect information. We use cookies to enable and support security features, to analyze how visitors use the site, and to monitor and fix site performance. The information we collect using cookies will not be used to personally identify you, but cookies may recognize your IP address or device on repeat visits to the site. Most web browsers automatically accept cookies, but you can usually change your browser’s settings to prevent that or to notify you when a cookie is being placed on your browser. Because each browser is different, you should look at your browser’s “Help” menu to learn how to modify these settings. If you do disable cookies this may make your experiences on the site less efficient.

Currently, certain browsers, including Firefox, Google Chrome, Safari and Internet Edge, offer a “do not track” (or, “DNT”) option. This option, using a technology known as a DNT header, sends a signal to websites visited by the user about the user’s DNT preference, if any, set on the browser. We do not currently commit to responding to browsers’ DNT signals. We cannot make this commitment because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators.

4. SECURITY AND RETENTION OF PERSONAL INFORMATION. We are committed to protecting your personal information from unauthorized access, use, or disclosure. We maintain administrative, technical, and physical safeguards designed to protect the personal information collected through the site. However, no information or communication site can be 100% secure, so we cannot guarantee the absolute security of your information. In addition, we are not responsible for the security of information that you transmit to the site over networks that we do not control, including the Internet and wireless networks.

We will not retain data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations. We will also retain personal information for as long as we have any legal, tax, accounting, risk management, or other business need to do so.

5. YOUR RIGHTS AND CHOICES; HOW TO CONTACT US. You have certain rights regarding our collection and use of personal information, as follows:

A. Accessing Personal Information – You have the right to confirm whether we are collecting and using your personal information. You may also have the right to obtain information about what specific pieces of personal information you have provided to us, and to receive a copy of that information.

B. Reviewing and Correcting Information – You have the right to request that we update or correct contact information and other personal information we may have retained about you.

C. Deleting Information – You have the right to request that we delete personal information we may maintain about you. Please note that we may not be able to completely remove personal information in certain circumstances, such as if the data is not in a searchable format, if it is retained in backup systems, if we need the information in connection with a potential or ongoing business relationship, if it is needed to prevent fraud or abuse, or if we are otherwise required by law to keep it.

The above rights may be subject to limitations imposed by state law, which will vary depending on where you live.

If you would like to exercise any of the above rights, or if you have any questions about our privacy practices, you can contact us at info@trcretail.com.

6. THIRD-PARTY WEBSITES. The site may contain links to websites operated by third parties. You acknowledge and agree that we are not responsible for the collection and use of your information by such websites that are not under our control, and this Privacy Notice does not apply to any third-party websites. We encourage you to review the privacy policies of each website you visit.

If you are accessing or using the site from outside the United States, you consent to the transfer to, storage in, and processing within the United States, and understand that the United States may not provide the same level of protection for your information as your home country.
